The Bill

The plan does not address enforcement of Swedish prison sentences abroad. The closest principle is that penalties must be carefully designed based on what actually works and that legal certainty must be upheld, and the plan's general opposition to outsourcing socially important activities. On that basis rejection of the legislation is closest, but the conclusion is uncertain. The committee's reasoning about space shortage in criminal care is not addressed by the plan.

The plan wants to address the shortage of places through a well-equipped criminal justice system in public administration with a focus on rehabilitation and reintegration into society, not by moving enforcement operations abroad. It also requires democratic control over functions vital to society. The counter-proposal's demand to reject the bill therefore comes closest to the plan, even though the plan does not address enforcement in another country.

The plan takes no explicit position on what the committee actually decided — often because the committee's reason was procedural. The stance is derived and fully cited, but it does not show the party broke a commitment.

The plan's criminal care line is that rehabilitation and reintegration in society should be central and that reintegration measures should promote reintegration. Executing prison sentences abroad complicates this work and the convicted person's ties to Sweden, so the counter-proposal's demand to reject the bill is in line with the plan. The plan also establishes that crime prevention must not occur at the expense of the rule of law.

The plan does not take a position on enforcement of prison sentences abroad. The central commitment is instead that the entire justice chain shall be strengthened with more resources for criminal justice and that imposed sentences shall be enforced, which presupposes solving the shortage of places. A rejection of the entire bill leaves that problem unsolved, even though the plan simultaneously values the rule of law and individuals' rights.

The plan wants criminal justice to be expanded and lifestyle criminals to be kept locked up, and it affirms stronger international cooperation against crime in a society with more open borders. Rejecting the bill in its entirety gives no answer to the lack of places and therefore receives no support in the plan. The plan's requirement for rehabilitative content during prison time speaks to conditions on release, not to rejection.

The plan requires the state to consistently uphold the legal rules that have been decided and that criminal care is expanded substantially, which argues against rejecting a bill that shall remedy the shortage of places so that imposed sentences can actually be carried out. The plan's requirements for rehabilitation and adequate resources in criminal care qualify, but according to the committee, the bill considers connection to Sweden and care needs.

The plan explicitly promises to increase the number of prison places and to review the possibility of renting prison places abroad, precisely because overcrowding in remand facilities and prisons has become unsustainable. The counter-proposal wants to reject the legislative proposal that would make such enforcement abroad possible. The plan therefore directly contradicts the counter-proposal's requirement.

The plan explicitly requires that the availability of prison places be expanded within and outside Sweden and that substantial investments be made in prisons. The counter-proposal wants to reject the bill that makes serving prison sentences in Estonia possible, which directly undermines that commitment. The plan's shift towards incapacitation reinforces this conclusion.
