Gender identity

The plan wants to see a gender identity law based on self-determination and a third legal gender, and sees it as crucial to strengthen LGBTQIA+ people's rights when authoritarian right-wing forces attack them. The counter-proposal demands the opposite: requirements for established diagnosis, government review and that legal gender should follow the biological. This is in direct conflict with the plan's commitment.

The party programme wants a society without homophobia and transphobia and counts gender identity among the power structures that limit people's freedom, while at the same time every person shall have control over their own life. The counter-proposal wants to abolish the more open order and again require diagnosis and authority examination to change legal gender. It runs counter to the plan's freedom and equality commitments.

The plan explicitly requires a new gender recognition act that strengthens transgender people's rights and moreover wants to introduce a third legal gender, based on the principle that people have the right to define themselves. The counter-proposal, by contrast, wants to repeal the more open system and maintain requirements for diagnosis and government review. The plan thereby directly contradicts the counter-proposal's demand.

The counter-proposal demands that the more open arrangement be abolished and that diagnosis and state assessment again shall govern legal sex. The plan builds instead on the idea that neither the state nor society shall define a person or stand in the way of their development, and the party points out restrictions on LGBTQI persons' rights as an authoritarian trait to resist. The right to create one's own identity and the prohibition on discrimination based on gender identity lead in the same direction.

The plan takes no explicit position on what the committee actually decided — often because the committee's reason was procedural. The stance is derived and fully cited, but it does not show the party broke a commitment.

The party programme establishes that no laws may disadvantage persons on the basis of gender identity or gender expression and that every person has the right to self-determination. The counter-proposal requires that the more open arrangement for changing legal gender be abolished and that medical diagnosis and government review be required, which directly conflicts with these commitments. The election manifesto also makes LGBTQ reforms a matter of freedom and wants Sweden to become the world's best country to live in as an LGBTQ person.

The plan requires that care be safe for patients and based on knowledge and proven experience and that all people's inalienable dignity characterizes rules and practice in the medical ethics area. The counter-proposal's requirement for continued medical investigation with established diagnosis and authority review, with reference to more children seeking care and more who regret it, aligns with this and with the best interests of the child being paramount. The question of legal gender is not explicitly addressed in the documents.

The plan explicitly takes a stance for LGBTQ people's right to live a free life and wants to prohibit conversion therapy that aims to change an individual's gender identity, which presupposes that gender identity is the individual's own matter. The counter-proposal's requirement that legal sex shall follow biological sex and that medical diagnosis and government review shall be required goes against that line. The plan's requirement that reforms shall rest on proven experience admittedly speaks for caution, but does not support the requirement.

The plan specifically points to hormone treatment and surgical procedures to change sex in children as serious and states that the long-term effects are not known, and requires that society's handling of children with gender dysphoria is investigated. It wants to end political experiments on children and young people and assumes that human biological sex should not be relativized. A precautionary line that maintains requirements for diagnosis and permit review thus follows directly from the plan.
