Proportionality and degree of suspicion

Proportionality assessment and degree of suspicion for police AI facial recognition

What's at stake: How the proportionality assessment is designed and how high the suspicion threshold is set determines how readily police can use facial recognition against individuals in public spaces, weighing the effectiveness of crime-fighting against the personal privacy of a potentially large number of people.

Case texts and AI reasoning are AI-translated from the Swedish originals; the Swedish text is authoritative.

What the vote decides

The question is whether the government's proposal on the proportionality assessment and degree of suspicion for police use of real-time AI facial recognition is sufficiently regulated, or whether the government should return with clearer criteria and a raised threshold of suspicion.

Yes Yes — the committee proposal

The committee agrees with the government's assessment that the proposed regulation strikes a reasonable balance between the need for effective law-enforcement tools and the individual's right to protection of personal privacy, with the technology usable only when absolutely necessary and proportionate and surrounded by requirements for authorization and notification, and therefore rejects the motion.

No No — the reservations

Reservation 3 (MP)

The reservation holds that the government must return with clearer regulation of the proportionality assessment, with clearer criteria for which factors should be weighed in and how limits on time and place should be drawn, and wants to raise the threshold of suspicion for using the technology from 'reasonably suspected' to 'probable cause', for a more restrained and legally secure regulation.

What do the votes mean here?

Yes The committee proposal: rejecting the motions (keeping things as they are).

No Backing the counter-proposal: reservation 3 by MP.

Abstain The party marks a position of its own that is not one of the two final alternatives.

What each plan points to — and how the party voted

For each party: the vote its own election manifesto and party programme point to in this case, next to how the party actually voted. A plan can only point to Yes or No; a party can also abstain.

Committee proposal

The Riksdag rejects motion 2025/26:3953 by Ulrika Westerlund et al. (MP) amendments 4 and 5.

Original (Swedish)

Riksdagen avslår motion 2025/26:3953 av Ulrika Westerlund m.fl. (MP) yrkandena 4 och 5.

Riksdag decision: The Riksdag approved the Government's proposal to give the Police Authority the opportunity to use AI technology for real-time facial recognition. The proposal means that the Police Authority shall be able to use AI technology if it is absolutely necessary to locate or identify a certain person who is suspected of being subjected to abduction, human trafficking or human exploitation or who is missing and suspected of being a victim of a crime if there is an imminent risk that the person will commit a serious crime that poses a danger to another person's life or physical safety who can reasonably be suspected of having committed a certain serious crime for which the penalty scale includes imprisonment for four years or more or such a penalty may follow for attempt, preparation or complicity in such crimes, in order to investigate or prosecute the crime who has been convicted of such a serious crime, in order to enforce the criminal sentence. The use of the technology shall be proportionate and require authorization from a prosecutor or court. In urgent cases, the use may commence without authorization and an application for authorization must be made within 24 hours. The new law and other legislative amendments come into force on July 1, 2026.

The plan establishes that all people have the right to protection of their personal integrity and that legal security must be upheld through transparency and independent oversight, with the presumption of innocence as the foundation.

Plan documents: party programme · 2022 manifesto

Reasoning and quotes

The plan establishes that all people have the right to protection of their personal integrity and that legal security must be upheld through transparency and independent oversight, with the presumption of innocence as the foundation. A higher threshold of suspicion and more clearly regulated proportionality assessment make the use of facial recognition more restrained and legally secure. The plan therefore supports the counter-proposal's demands.

The plan wants to give the police more tools and wage an uncompromising fight against organized crime.

Plan documents: 2022 manifesto · party programme

Reasoning and quotes

The plan wants to give the police more tools and wage an uncompromising fight against organized crime. Raising the suspicion threshold from reasonably suspected to probable grounds would severely restrict the tool precisely in the early stages where it is needed. The plan simultaneously values personal integrity, which makes the stance uncertain.

The plan requires that coercive measures be weighed against personal integrity and that strong independent oversight ensures legal certainty and proportionality, and that new legislation be carefully examined in light of fundamental freedoms and rights.

Plan documents: party programme

Reasoning and quotes

The plan requires that coercive measures be weighed against personal integrity and that strong independent oversight ensures legal certainty and proportionality, and that new legislation be carefully examined in light of fundamental freedoms and rights. A higher degree of suspicion and clearer proportionality factors are precisely such restraint. The counter-proposal's demand thereby aligns with the plan.

The plan demands strong privacy protection, that all legislation be tested against its impact on personal privacy and says no to preventive surveillance.

Plan documents: party programme · 2022 manifesto

Reasoning and quotes

The plan demands strong privacy protection, that all legislation be tested against its impact on personal privacy and says no to preventive surveillance. A raised suspicion level and clearer criteria for proportionality assessment is precisely the restraint the plan demands when coercive measures are used. The plan does not explicitly address suspicion levels, which is why the position is derived.

The plan explicitly wants secret coercive measures to be usable when there is suspicion of more crimes than today and for the police to have more tools.

Plan documents: 2022 manifesto · party programme

Reasoning and quotes

The plan explicitly wants secret coercive measures to be usable when there is suspicion of more crimes than today and for the police to have more tools. The counter-proposal, by contrast, wants to raise the threshold of suspicion from reasonable suspicion to probable cause, thus narrowing the use. This goes against the plan's line on more effective crime prevention, although the plan's commitment to integrity speaks for clearer proportionality rules.

The election manifesto establishes that security must be restored and that criminals shall be sentenced, and the party programme emphasizes rapid reaction to crime and increased detection risk.

Plan documents: 2022 manifesto · party programme

Reasoning and quotes

The election manifesto establishes that security must be restored and that criminals shall be sentenced, and the party programme emphasizes rapid reaction to crime and increased detection risk. Raising the degree of suspicion to probable cause would limit a tool that is to increase detection risk. The plan's requirement for strong privacy protection qualifies but does not support such a raising.

The plan assumes that far too few serious crimes are solved and therefore wishes to give the police more and more powerful tools, from stop-and-search zones to significantly more surveillance cameras.

Plan documents: 2022 manifesto · party programme

Reasoning and quotes

The plan assumes that far too few serious crimes are solved and therefore wishes to give the police more and more powerful tools, from stop-and-search zones to significantly more surveillance cameras. Raising the suspicion threshold from reasonable suspicion to probable cause would cut out a large part of the scope before an investigation has gone so far. The plan therefore speaks against the counter-proposal's demand for a more restraint-based regulatory framework.
