Pre-emption Act

The plan wants to give the public stronger tools over land and housing and requires an active land policy, which municipal and state pre-emption rights are a direct expression of. That the pre-emption right should also be used against organised crime responds to the plan's requirement for effective monitoring of organised economic crime. The plan does not address the pre-emption law as such, but the direction towards increased public scope for action is clear.

The plan requires forceful combat against organized criminal activity and that Swedish resilience and citizen security be placed before market interests. A pre-emption right for the state in defence properties and for municipalities against organized crime are tools for exactly this, and a broader municipal perspective responds to the plan's demand for strengthened municipal control. The plan does not, however, mention pre-emption legislation.

The plan wants to strike at organized crime's businesses from multiple directions and strengthen efforts against criminal economy, as well as having municipalities use their land policy and opportunities to set requirements. A right of first refusal against criminal property acquisitions and for defence purposes is a tool in that direction. The plan therefore supports the counter-proposal's demand.

The plan wants to strengthen property rights and warns against arbitrary interference in individual ownership. A new right of first refusal law gives the state and municipality the right to intervene in individuals' property transactions, and the counter-proposal also wants to broaden the municipal perspective further. Although defence needs weigh heavily in the plan, the documents do not support such an expansion of public interference in property rights.

The plan makes the right to buy and sell property one of the necessary freedoms and meets increased public power claims with healthy skepticism. The counter-proposal wants not only a right of first refusal for defense and crime prevention purposes but also to reinstate a broader municipal perspective, which expands the public's intervention in property rights. The plan's security policy view of strategic assets speaks for the narrower part of the proposal, but not for the broad part.

The party programme establishes that the right to property is a human right and that forced acquisition is a violation of property rights that should be applied only in exceptional cases. A new pre-emption law, and especially a reintroduced broader municipal perspective, constitutes a general restriction on the right to freely transfer real property. The plan's answer to such needs is good advance planning rather than coercive instruments. The plan's wish to combat gang crime is not sufficient to support such a broad intervention.

The party programme establishes that state and municipality may take over individuals' property only in exceptional cases and only when motivated by particularly strong grounds and pressing public interests. The counter-proposal wishes beyond defence and crime-fighting grounds to reintroduce a broader municipal perspective in right-of-first-refusal, which widens the intrusion on ownership beyond the exceptions. The plan shares the substantive grounds on security-sensitive business and organised crime.

The plan believes that few political measures are too far-reaching when it comes to pushing back organized crime gangs, and requires that clan power be counteracted both within the public sector and in civil society. A municipal pre-emption right against organized crime and a state pre-emption right for defense facilities are such tools, and the latter addresses the plan's requirement for rearmament in a new security situation. The intervention in property rights speaks partially against it.
