New reporting obligations

The plan states that all people have the right to protection of their personal integrity and that authorities have a special responsibility to treat all people with the same respect. A standard of proof based merely on suspicion opens the door to arbitrariness and for information to be provided based on how someone looks, which the plan explicitly warns against when it describes racism in authority operations. A higher standard of proof and exceptions for incidental information thus follow from the plan's commitments.

The plan explicitly states that secrecy barriers between government agencies shall be removed so that the police and other professions can do their job. Raising the burden of proof and exempting side information would instead build new thresholds for information sharing. The plan moreover maintains a tight migration policy, even while it protects personal integrity.

The counter-proposal wants to raise the evidentiary standard for the reporting obligation and exempt secondary information, to avoid arbitrary assessments of which people information concerns. The plan requires that the state respects people's personal privacy, that new legislation be examined carefully against fundamental rights and that work against all forms of racism be strengthened. Rights also extend to undocumented migrants.

The party programme makes strong privacy protection an indispensable part of a democratic society and requires proportionality between legislation's intrusion and its purpose. A higher burden of proof than reasonable cause to suspect, and an exception for incidental information, is just such a proportionality weighing against arbitrariness. The election manifesto also explicitly says no to reverse burden of proof and similar general coercive measures.

A raised burden of proof and an exception for ancillary information is precisely the limitation these principles require. The plan wants to remove obstacles for authorities to share information and establishes that those denied asylum must quickly leave the country, otherwise a shadow society grows. An elevated standard of proof and exceptions for ancillary information would choke off precisely the information flow that makes return migration effective. The plan's integrity principle speaks in part against this, but the demand is rejected.
