Labour disputes

The plan wants to change labour dispute law in the direction of strengthening wage-earners' positions, not restricting them. The counter-proposal instead requires that sympathy actions are restricted and that labour actions may not be used to drive forward collective agreements. It goes directly against the election manifesto's promise to defend the right to bargain and strong labour law and the requirement that all employees shall be protected by strong collective agreements.

The party programme explicitly lists the right of trade unions to take strike and sympathetic action among the goals to be defended. The counter-proposal wants to restrict precisely sympathetic action and prohibit strike action to enforce collective agreements, which goes directly against that commitment. The plan instead wants to strengthen trade unions' position and make collective agreements the norm.

The plan protects the Swedish model where the parties themselves negotiate what should apply and wants to encourage union organisation and protect well-functioning labour law. To limit sympathy measures and the right to demand collective agreements through legislation would restrict exactly the party autonomy and union tools the plan protects. The counter-proposal's requirement is therefore rejected.

The election manifesto makes Centerpartiet the advocate for small businesses and the party programme requires clear and predictable rules in the economy as well as good conditions for self-employed and small businesses. The counter-proposal's requirement that punitive measures should not hit uninvolved sub-contractors protects precisely those companies. The plan does not address the conflict rules directly, so the stance is derived.

The plan explicitly requires a rule about reasonable proportion between the purpose of a industrial action and the means used, which is precisely the limitation the counter-proposal seeks when uninvolved parties are hit. It simultaneously values union freedom and collective agreements, so the requirement applies to proportionality and not to the right to strike as such. The plan's consistent concern for small businesses' conditions and fair competition points in the same direction.

The plan wants labor law to give small businesses the opportunity to grow strong and makes fairness into a balance between all parties' interests, which speaks for uninvolved subcontractors not to bear the damage from a conflict they cannot influence. At the same time, the plan establishes that strong and independent trade unions are indispensable and that the design shall be done by the parties themselves, which speaks against legal regulation. The basis is therefore weak and the position uncertain.
