Rejection of the proposition

The party programme states that all people have a right to protection of their personal integrity, that presumption of innocence is fundamental, and that legal certainty is maintained through transparency and independent scrutiny. The election manifesto warns that repression and a harder line are put forward instead of addressing problems seriously. The counter-proposal's requirement for rejection and a joint review before secret room surveillance and preventive house searches are introduced follows these commitments.

The election manifesto explicitly establishes that the police need more tools, such as better possibilities for wiretapping and house searches, and that the fight against crime should be uncompromising. The counter-proposal wants to reject the entire proposition and await a comprehensive review before preventive room wiretapping and house searches are introduced, which is the opposite of the plan's commitment. That the plan also values personal integrity does not change the main line. The plan therefore speaks against the counter-proposal's demand.

The party programme explicitly states that the party opposes all laws that constitute disproportionate interference in privacy and that crime prevention must not take place at the expense of human rights. Secret room surveillance and house searches for preventive purposes, without preliminary investigation, are precisely such expanded surveillance powers that the plan requires politics to guard against. That the plan at the same time wants to give the judiciary tools against organized crime lowers the security somewhat.

The election manifesto explicitly says no to preventive wiretapping and to reversed burden of proof and collective punishment, with reference to the fact that the rule of law and the individual's rights vis-à-vis the state must be defended. The party programme requires that all legislation is tested against its impact on personal integrity and that the restriction is proportionate to the purpose. The counter-proposal's demand to reject the government bill on secret room wiretapping and house searches for preventive purposes is therefore the plan's own position, even though the party elsewhere wants to tighten efforts against gangs.

The plan explicitly requires that secret coercive measures shall be able to be used for more crimes and after court decision against organised gang members even without concrete suspicion of crime. To reject the proposition and await a comprehensive review is the opposite of that commitment. The plan requires at the same time that infringement of privacy only happens when countervailing interest weighs demonstrably heavier, but that does not lead to rejection but to the balance being tested.

The election manifesto's commitment is that security shall be restored and that the justice system shall receive new tools, including a comprehensive review of confidentiality rules and anonymous witnesses. Rejecting expanded crime prevention coercive measures pending a comprehensive review goes against this. The plan's strong protection for personal integrity, however, requires balance, which the committee strikes.

The plan states that gangs are Sweden's domestic terrorists and that legislation must be adapted accordingly, and it promises new tools such as search zones, anonymous witnesses and significantly more surveillance cameras. The plan requires that the justice system receive more effective tools against gang crime, explicitly through information gathering, surveillance, camera surveillance and wiretapping, and that procedural obstacles for increased prosecution are removed. The counter-proposal wants to reject the entire bill on expanded preventive coercive measures, which goes directly against the plan's stance that few measures are too far-reaching when gangs are to be pushed back.
