Government's legislative proposal

The election manifesto states that repression and tougher action are too often presented as solutions instead of comprehensive preventive action, and instead demands a strengthened social services with resources for preventive work and child protection. The party programme's commitment to always put the child's best interests first points in the same direction. A legally regulated possibility to keep children in isolation at night therefore goes against the plan, and the counter-proposal's requirement for rejection is in line with it.

The election manifesto requires more and more far-reaching social measures and that social services be strengthened to catch young people in time and prevent young people from becoming criminals. Rejecting a bill designed to create a safe environment at night in special youth homes goes against that line. The plan's commitment to children's safe upbringing according to the child convention pulls in the opposite direction, wherefore the conclusion is uncertain.

The plan's line on children and young people in state care is that investments come before restrictions and that preventive work, care measures and children's rights are the foundation. To legislate on the possibility of keeping children in isolation is the opposite of this and would need to be tested against the Convention on the Rights of the Child and a child impact assessment. The plan therefore supports the counter-proposal's demand to reject the bill in its entirety.

The proposal creates a new legally regulated possibility to hold children and young people in seclusion, that is, a coercive measure against children. The plan's principle is that all legislation must be tested against its impact on personal integrity with requirements for proportionality, and that children's rights and perspective must carry the most weight in all society's functions. The plan also places preventive measures and early care for children and young people at the centre rather than coercion, which supports the counter-proposal's demand for rejection.

The plan wishes to expand, not restrict, society's coercive measures against young violent offenders: separate prisons for young people, more forced removals and an end to queues for emergency placements. A rejection of the entire bill would remove precisely the legally regulated opportunity needed to maintain order at night. The election manifesto explicitly requires that social services' options for coercive measures against children and young people be strengthened, which is precisely what a legally regulated seclusion in connection with overnight rest entails. The counter-proposal requires rejection of the entire bill and thus runs directly counter to this commitment. The plan sees safety for children and young people as a public responsibility where preventive measures need to be complemented by interventions. That coercion should be used restrictively qualifies but does not reverse the support.

The counter-proposal wants to reject the bill on being able to keep children and young people in isolation in connection with night rest in special youth homes. The plan is built on young people who commit serious crimes meeting swift and clear consequences, more being taken into care according to LVU, youth prisons being investigated and placed young people being given better preconditions. Removing the possibility of coercive measures to prevent absences at night goes against that line. Therefore the plan rejects the demand.

The plan requires that social services, schools and the justice system have the opportunity to intervene with tougher measures at an early stage and that social services have tools to intervene with forceful measures when young people fare poorly, including apprehension. The counter-proposal wants to reject the bill on seclusion in connection with rest periods at special youth homes, which would deprive the operation of just such a tool. The plan's requirement that apprehended children should be able to rely on society's care also speaks for a safe environment at night.
